Regulations in force in Poland
Own house is a dream, the implementation of which requires the completion of many formalities, preparation of a complete set of documents and obtaining the appropriate permits. The legal regulations introduced in 2015 partially simplify the procedures and allow the construction of houses without a permit, so if the house does not exceed 35 m2 of the building area, then no building permit is required, but only a construction notification to the competent office. Therefore, in order to be able to take advantage of the amendment to the construction law, we offer ready-made projects of houses in which there is a simplified construction procedure without a permit.
Cottages without a building permit – Art. 29
In accordance with the applicable provisions of the Construction Law, Art. 29 .:
A building permit is not required for the construction of (among others):
1A) detached single-family residential buildings, the impact area of which is entirely on the plot or plots on which they were designed;
2A) detached single-story buildings for individual recreation, understood as buildings intended for periodic rest, with a building area of up to 35 m2, the number of these objects on the plot may not exceed one for every 500 m2 of the plot area;
Application for a cottage with an area of up to 35 m2
The application is made according to the application template available at the office, it should contain the type, scope and manner of construction works, as well as the date of their commencement. In accordance with the adopted nomenclature, the planned investment should be described as “an individual recreation building”, not a “single-family house”. A residential house, regardless of its size, requires a building permit.
The application for the construction of a house up to 35 m2 should be supplemented with a statement on the right to use the property and a drawing of the object. They are to show building projections, dimensioning and location on the plot – preferably on a copy of the main map.
A house without a permit must meet several conditions:
• the area cannot exceed 35 m2,
• the house must be free-standing,
• no more than one house can be built on the plot of 500 m2,
• the house must be a one-story house without an attic.
